Early in 2017, the United States of America Toxic Substances Control Act (TSCA) announced the introduction of a rule on the 'Reporting and Recordkeeping Requirements' for chemical substances when manufactured or processes as nanoscale materials. The rule was originally supposed to come into force on 12 May 2017. The US Environmental Protection Agency (EPA) has decided to postpone the enforcement of the rule to 14 August 2017 because ‘of the complex issues regarding reporting requirements’.
US EPA is taking steps towards the publication of a Guidance document to guide and facilitate registration. The US EPA has issued for consultation a Draft Guidance of this reporting rule. It intends to clarify on the following:
- what chemicals are reportable?
- who is required to report?
- when is reporting required? and,
- other general issues
